1. Who we are

ZestEnergy (zestgameplay.com, the "Site") is operated by ZestEnergy Ltd, a company registered in England and Wales, with its registered office at 4 Higher Swan Lane, Bolton BL3 3AQ, United Kingdom ("we", "us" or "the operator").

By using the Site you agree to these Terms. If you do not agree to them, please do not use the Site.

2. What we offer — and what we do not

The Site provides free-to-play social games in the style of slot machines and other casual entertainment: Slot Egypt, Kingdom Elf, Night City, Pirate Slot, Slot Candy, Arena of Honor, Shadow Forest, Slot Lantern and Slot Pan. These games are for entertainment only.

We do not offer real-money gambling. The Site is not a gambling service within the meaning of the Interactive Gambling Act 2001 (Cth): you do not pay or stake any consideration for the chance of winning money or money's worth, and no prize of money or money's worth can be won. We are not a casino, a lottery operator, a bookmaker or a betting service, and we hold no gambling licence in Australia, the United Kingdom or anywhere else.

Practice or success at social casino gaming does not imply future success at real-money gambling. Real-money gambling works differently, involves financial risk, and is regulated separately in each Australian state and territory.

3. You must be 18 or older

The Site is available only to people aged 18 and over. By using it you confirm that you are at least 18. We check age at the entrance to the Site and may ask for proof at any time. If we find that a user is under 18, we will block access and delete the account and the data connected to it.

4. Virtual coins

You receive virtual coins inside the games. They are part of the game mechanics and have no monetary value. Virtual coins:

• cannot be cashed out, exchanged, transferred or redeemed for money, goods or prizes;
• are not a balance, a deposit, credit or a means of payment;
• remain our property at all times; you receive only a revocable, personal and non-transferable licence to use them inside the games;
• are forfeited without compensation if your account is closed, suspended or deleted;
• give rise to no claim for compensation if a game or the Site is discontinued.

Trading virtual coins outside the Site, selling them and exchanging them for anything of real value is prohibited.

5. Your account

Some features require an account. You agree to give accurate information, to keep your login details confidential and to tell us at ZestEnergy@proton.me about any unauthorised use. One account per person is allowed. We may suspend or close an account where these Terms are breached, in particular for false statements about age, multiple accounts, manipulation of the games, or abusive behaviour towards other users or our support team.

6. The games on this Site

All games on this Site are developed and owned by ZestEnergy Ltd. Their software, artwork, sound, names and underlying mathematics are our property. Games may be added, changed or removed at any time.

We may license our games to other operators for use on their own platforms. Any such use is governed by a separate agreement and does not transfer ownership.

We are not associated with, endorsed by or sponsored by any casino, lottery operator, sportsbook or other real-money gambling operator, and we do not display the names, logos or marks of any such business.

7. Acceptable use

You agree not to use the Site in order to:

• bypass security measures, the age check or access restrictions;
• use automated scripts, bots, crawlers or emulators;
• manipulate game outcomes, scores or coin balances;
• copy, distribute or commercially exploit the content of the Site;
• transmit unlawful, offensive or harassing content;
• make the Site available to anyone under 18.

8. Intellectual property

All content on the Site — software, graphics, text, audio, the ZestEnergy name and logo, and the layout — is protected and belongs to us. You may not copy, adapt, reproduce or distribute it without our written permission, except as the law expressly allows.

9. Development services

We also build social games, mobile applications and web application shells for other businesses. Those services are described on our Development services page and are provided under a separate written agreement. Nothing on that page forms an offer capable of acceptance, and no contract arises until both parties sign.

10. Availability and changes

We aim to keep the Site running, but we do not promise uninterrupted availability. We may change, restrict or discontinue games, features or the Site as a whole. We will announce material changes to these Terms on the Site; the version in force is always the one published here. If you continue to use the Site after a change, you are taken to have accepted it.

11. Liability

The games are provided "as is". To the extent permitted by law, we are not liable for indirect or consequential loss, loss of profit or loss of data.

Nothing in these Terms limits or excludes any right or remedy you have that cannot be limited or excluded by law. If you are in Australia, that includes the consumer guarantees under the Australian Consumer Law. Nothing in these Terms limits our liability for death or personal injury caused by negligence, or for fraud.

12. Responsible play

Free games can still be played to excess. Guidance and free, confidential support services in Australia are listed on our Responsible Social Play page.

13. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you are resident in Australia and use the Site as a consumer, this does not deprive you of the protection of the mandatory consumer laws of Australia, and you may also bring proceedings in the Australian courts where the law allows.
